Only individuals who reside or have a residence in the following European Union countries, hold a valid identification document issued by the authorities of any country, and have their own profile on the Mobilredfox webshop, as well as natural persons who have reached the age of 18 and are capable of acting and are not among the excluded persons ("Player") can participate in the game. Participating countries: Hungary, Czech Republic, Croatia, Poland, Spain, Portugal, Germany, Austria, Romania, Bulgaria, Greece, Latvia, Lithuania, Estonia, Slovenia, Slovakia, Netherlands, Belgium. Individuals who have not reached the age of 18 can only participate in the game with the consent of their legal representative and can receive the prize with the consent. The consent must be presented at the request of Mobilredfox customer service. To participate in the game, you must purchase a Product from the Mobilfox website. The prize consists of one black Wormhole hoodie, one brown Wormhole hoodie, one Vision hoodie, one Unreal baseball cap, four pairs of socks, two Timeless t-shirts, one Transition t-shirt, and one Kennedy t-shirt (Prize). The Organizer reserves the right to change the Prize and replace it with a similar, different type, or higher value prize. We inform you that every registered player who makes a purchase during the entire duration of the Prize Game participates and by making the purchase, you accept the provisions of these Game Rules. The game does not qualify as gambling under Act XXXIV of 1991 on the organization of games of chance. MOBILREDFOX creates a closed database from the players participating in the game. From this database, MOBILREDFOX randomly (without human intervention) selects the winner by computer at the specified time in the presence of a notary public. The draw is not public. The Organizer will draw a total of 12 (twelve) Winners. If the winner's participation in the Game is invalidated for any reason, or if the winner does not collect the Prize at the specified time and pre-arranged place, MOBILREDFOX will not announce a substitute winner. |

Prize: |
The prize consists of 1 (one) black Wormhole hoodie, 1 (one) brown Wormhole hoodie, 1 (one) Vision hoodie, 1 (one) Unreal baseball cap, 4 (four) pairs of socks, 2 (two) Timeless t-shirts, 1 (one) Transition t-shirt, and 1 (one) Kennedy t-shirt. MOBILREDFOX will notify the winner within 48 hours after the draw as follows ("Notification"):
The winning player must confirm the Notification within 48 hours and get in touch with MOBILREDFOX customer service. (To ensure the clear identification of the winner, it is necessary to present a photo ID through video call or in person to MOBILREDFOX customer service. These personal data will not be stored.) In the case of a child who has not reached the age of 18, the identification of the parent or guardian exercising parental responsibility over the child is required in the same manner. If the winner fails to confirm the Notification within the specified deadline or fails to provide the necessary data for receiving the prize, the winning player will be disqualified. MOBILREDFOX excludes from the game any player whose prize cannot be handed over due to the personal data provided in the confirmation of the Notification being untrue, incomplete, or incorrect, or if the player does not meet the personal requirements stated in these Game Rules for any other reason. The Organizer bears no responsibility for any consequences resulting from incorrect provision of data by the player. The Organizer emphasizes that its responsibility is solely limited to providing the prize, and it is not obliged to ensure any additional conditions related to the use of the prize. |

MOBILREDFOX excludes any liability for any circumstances arising after the handover of the prizes, during the use or in connection with the use of the prizes by the winner or any third party. The following organizations, agencies, their owners, executive officers, employees, or individuals in any other contractual relationship with them, as well as their relatives as defined in Section 8:1 (1) Point 2 of the Civil Code, cannot participate in the game: MOBILRENDFOX and entities involved in the organization or implementation of the Game. Participation in the game is voluntary. The winner shall not be entitled to further claims against MOBILREDFOX if they lose their eligibility for the prize due to unsuccessful contact (e.g., not receiving the message due to individual email or social media settings, etc.). Therefore, MOBILREDFOX excludes its responsibility for any failure in the delivery of the prize resulting from the winner's unavailability for any reason after the award has been announced. If the winner's provided data is not accurate, incomplete, or does not qualify for claiming the prize, MOBILREDFOX will not announce a reserve winner. The presentation of a personal identification document is required for receiving the prize. If the winning player cannot present their ID (or passport) when receiving the prize, they will lose their eligibility. In this case, there won’t be a reserve winner. MOBILREDFOX will provide travel for the winner (or reserve winner) (1 person) to the location of prize handover (Budapest). MOBILREDFOX will also provide one night's accommodation at a selected Budapest hotel chosen by MOBILREDFOX. MOBILREDFOX will not provide transportation for the winner's return journey. The necessary personal data for arranging accommodation and travel will be collected by MOBILREDFOX and forwarded to the service partners in accordance with the applicable regulations. The winner is responsible for all other expenses. If applicable, MOBILREDFOX will cover and pay for the postage costs. MOBILREDFOX excludes its responsibility for any malfunction of the website due to reasons beyond its control, which may result in the website being inaccessible or limited during that time. However, MOBILREDFOX will take immediate action to identify and resolve the cause of the error. MOBILREDFOX excludes its responsibility for any external attacks on the website or the server operating it. Therefore, MOBILREDFOX does not assume any liability for incorrect system messages resulting from attacks on the website or the server. MOBILREDFOX is not responsible for the availability and operation of telecommunication and IT equipment or the activities of third parties. MOBILREDFOX is not responsible for the incorrect operation of online platforms due to reasons beyond its control, including but not limited to: server errors or unavailability, lack of internet connectivity, backbone network malfunctions, or unsuccessful connection to the online platform or any part thereof. MOBILREDFOX will make every reasonable effort to ensure that participation in the prize game is possible on widely used computer types, operating systems, and internet browsers. However, MOBILREDFOX does not guarantee and is not responsible for the efficiency of using different systems during participation in the prize game. Participation in the game with a profile registered by a third party is strictly prohibited. If a player does not use a personally registered customer profile, they will be automatically excluded from the game. MOBILREDFOX excludes any responsibility regarding disputes arising from the use of customer profiles related to the game. When participating in the game, players will be identified based on their username in the Mobilredfox website user account. The Organizer bears no responsibility for technical problems outside its scope (such as profile deletion or unavailability) arising from possible changes to the data. By participating in the game, players accept the principles of impartial and moderated communication. MOBILREDFOX does not intend to engage in negative communication regarding the game or MOBILREDFOX. Any questions or objections related to the game or game organization should be addressed via message to info@mobilfox.com. The data provided during the game will be stored in the MOBILREDFOX database and used in accordance with the provisions of the Game Rules. MOBILREDFOX reserves the right to modify the conditions specified in these Game Rules. MOBILREDFOX is entitled to exclude any player from the game, especially if there is suspicion of abuse or violation of the conditions or if a player manipulates the course of the game or acts in bad faith. The game can be terminated before the specified duration expires due to force majeure (including but not limited to war, earthquake, disaster, epidemic, strike, or similar unexpected events), including cases where the Organizer is unable to ensure the proper implementation of the game due to reasons beyond its control. The Organizer shall not be liable for any damage or costs resulting directly or indirectly from the use of the game or the modification of the Game Rules, the suspension, prohibition, interruption, or termination of the game. Players participating in the game expressly acknowledge this. If any technical or security problem arises during the game, making the lawful conduct of the game impossible or endangering it, the Organizer reserves the right to suspend or terminate the game. Notification of any amendments to these Game Rules or the suspension or termination of the game will be published by MOBILREDFOX on the following page: https://mobilfox.com/pages/summersale-jatekszabalyzat The Organizer automatically excludes participants who provide false information from the game. The Organizer may examine the fulfillment of the Game Rules by the players for any reason, and if they do not comply with the conditions for any reason, the affected player may be excluded from the game. No further legal dispute can arise regarding the exclusion. Players demonstrating behavior as described in this section, which indicates unfair conduct, are obliged to reimburse any damage caused to the Organizer in connection with the game. MOBILREDFOX reserves the right to immediately exclude any player from the game if they detect any (computer) manipulation, mass generation of profiles, or any behavior incompatible with the spirit of the game or offensive to it. MOBILREDFOX assumes no responsibility for any failure or delay in the delivery of the prize that is beyond the Organizer's control. If the winner does not collect their prize at the prearranged time with the Organizer, they cannot demand it from the Organizer thereafter. Hungarian law is applicable to this Game and Game Rules. Taxation MOBILREDFOX will cover any potential taxes and contributions related to the receipt of the specific prize based on the personal data provided by the winner. |
PRIVACY DATA PROCESSING NOTICE
By accepting the Terms, you expressly consent to MOBILREDFOX, as the data controller, processing and storing your data in accordance with the provisions of the privacy data processing notice, based on Article 6(1)(a) of the General Data Protection Regulation (GDPR) and the applicable legal regulations, for the purpose of participating in the Prize Game and maintaining contact, until the fulfillment of the data processing purpose or until the withdrawal of your consent.

Legal Basis for Data Processing
Please be informed that the data of the participants are processed by MOBILREDFOX based on the consent of the player in accordance with Article 6(1)(a) of the GDPR, and the data of the selected winners are processed by MOBILREDFOX based on Article 6(1)(b) of the GDPR for the purpose of delivering the prizes and fulfilling the gift contract.
Scope of Processed Data and Data Retention Period
During the organization of the Prize Game and the dispatch of prizes, MOBILREDFOX processes the following data:
For all players: Name, Email address, Phone number. For winners: Name, Email address, Phone number, data required for organizing accommodation and travel as requested by the accommodation provider and travel organizer.
The data retention period for the processed data is 5 years following the completion of the game, in accordance with the general limitation rules of the Civil Code. Financial data relating to the Prize Game, which qualify as accounting records, are retained by MOBILREDFOX for at least 8 years in accordance with Section 169(2) of Act C of 2000 on Accounting.
If your data is processed based on your consent, you have the right to withdraw your consent at any time without restriction, condition, or justification, by sending an email to info@mobilfox.com. Following the withdrawal of your consent, MOBILREDFOX will promptly delete your processed data.
Automated Decision-making (including profiling):
There is no automated decision-making, including profiling, during the data processing.
Recipients of Personal Data:
There is no targeted data transfer directly related to the Prize Game. However, in the case of registered accounts, the Data Controller may transfer data to data processors (in particular, Shopify and Infobip) through which certain personal data may be transferred to third countries (including the United States of America). Detailed information about the specific data transferred to data processors, the details of data processing, and the application of legal bases provided by Chapter V of the GDPR can be found in Annex 3 of the privacy data processing notice, which provides detailed information for the data subjects.
Data Security
The data controller takes all necessary measures to prevent accidental damage or destruction of data. Detailed information about specific data security measures is provided in the data processing notice.
Rights of the Data Subject
The data protection rights, remedies, and limitations thereof are outlined in detail in the GDPR (in particular, Articles 15, 16, 17, 18, 19, 20, 21, 22, 77, 78, 79, and 82). The most important provisions are summarized below.
Right to Information:
If the Data Controller processes personal data concerning the player, the Data Controller is obliged to provide the player with information about the key features of the data processing, including the purpose, legal basis, duration, the identity and contact details of the Data Controller and its representative, the recipients of the personal data, as well as the player's rights and remedies (including the right to lodge a complaint with the supervisory authority). The Data Controller provides this information by making this notice available to the player.
Right of Access:
The player has the right to obtain confirmation from the Data Controller as to whether personal data concerning them are being processed and, if so, access to the personal data and certain information related to the data processing, including the purposes of the processing, categories of personal data, recipients of the personal data, the (planned) duration of the data processing, the player's rights and remedies (including the right to lodge a complaint with the supervisory authority), as well as information about the source of the data, if the data were not collected from the player. Upon request, the Data Controller shall provide the player with a copy of the personal data being processed. For any additional copies requested by the player, the Data Controller may charge a reasonable fee based on administrative costs. The right to obtain a copy shall not adversely affect the rights and freedoms of others. The Data Controller shall provide information about the possibility, method, costs, and other details concerning the issuance of a copy upon the player's request.
Right to Rectification:
The player has the right to request the prompt rectification of inaccurate personal data concerning them. Taking into account the purposes of the processing, the player has the right to request the completion of incomplete personal data, including by means of a supplementary statement.
Right to Erasure:
The player has the right to request the erasure of personal data concerning them without undue delay, and the Data Controller is obliged to erase such personal data without undue delay if certain conditions are met. For instance, the Data Controller must erase the personal data upon the player's request if the data are no longer necessary for the purposes for which they were collected or otherwise processed, if the player withdraws their consent on which the processing is based and there is no other legal ground for the processing, if the personal data have been unlawfully processed, or if the player objects to the processing and there are no overriding legitimate grounds for the processing. The personal data must also be erased if their processing is required to fulfill a legal obligation imposed on the Data Controller by Union or Member State law or if the personal data have been collected in relation to the offer of information society services.
If the processing is based on the player's consent, the consequence of withdrawing consent is that the player will no longer use the application.
Please note that the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
Right to Restriction of Processing:
The player has the right to request the restriction of processing if one of the following conditions is met:
- a) The player contests the accuracy of the personal data, in which case the restriction applies for a period allowing the Data Controller to verify the accuracy of the personal data;
- b) The processing is unlawful, and the player opposes the erasure of the data and requests the restriction of their use instead;
- c) The Data Controller no longer needs the personal data for the purposes of the processing, but the player requires them for the establishment, exercise, or defense of legal claims.
When processing is restricted in accordance with the above, such personal data, with the exception of storage, shall only be processed with the player's consent, or for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the Union or a Member State.
The Data Controller shall inform the player in advance of the lifting of a restriction.
Right to Data Portability:
The player has the right to receive the personal data concerning them, which they have provided to the Data Controller, in a structured, commonly used, and machine-readable format, and has the right to transmit those data to another controller without hindrance from the Data Controller, where:
- a) the processing is based on the player's consent or on a contract to which the player is a party, and
- b) the processing is carried out by automated means.
When exercising the right to data portability, the player has the right to have the personal data transmitted directly from one controller to another, where technically feasible.
The right to data portability shall not adversely affect the right to erasure and shall not adversely affect the rights and freedoms of others.
Legal Remedies
The Data Controller makes every effort to ensure that the processing of personal data is in accordance with the applicable laws. If the data subject feels that the data controllers have not complied with this, they can submit their observations to the email address info@mobilfox.com or to the postal address Mobilredfox office, Dalszínház utca 2, 4th floor, 1061 Budapest. If the data subject believes that their right to the protection of personal data has been violated in accordance with the applicable legislation, they may seek redress from the competent authorities: the National Authority for Data Protection and Freedom of Information (1055 Budapest, Falk Miksa utca 9-11) or the court. The data subjects' remedies, among others, are provided for in the provisions of the GDPR. Data subjects have the right to request information about the processing of their personal data at any time, which the data controller can only refuse in exceptional cases in accordance with the relevant legal provisions. If the data controller denies the provision of information, they shall inform the data subject in writing, specifying the legal provision on which the denial is based. If the data subject seeks judicial remedy in case of a violation of their rights, the court shall handle the case expeditiously. The jurisdiction of the court for the resolution of the dispute lies with the competent court based on the data subject's place of residence or habitual residence, or at the discretion of the player. It is the responsibility of the data controller to prove that the data processing complies with the provisions of the law. If the data controller causes damage to others through unlawful handling of the data or breaches the requirements of data security, they are obliged to compensate for such damage. If the data controller violates the data subject's right to personal integrity through the unlawful handling of data or the breach of data security requirements, the data subject is entitled to claim compensation for damages. The data controller is exempt from liability for the damage caused and the obligation to pay compensation if they can prove that the damage or the violation of the data subject's right to personal integrity was caused by an unavoidable circumstance outside the scope of data processing. No compensation for damages can be claimed if the damage or the violation of the right to personal integrity caused by the data subject's intentional or grossly negligent behavior.
